This class action concerns alleged defects in design and manufacturing of the Kitec System that was manufacture, distributed and marketed in Canada by or on behalf of the defendants, sold by wholesale distributors in Canada and subsequently installed by builders or plumbers in properties in Canada.
The Kitec System ia a type of plumbing product, the components of which include Kitec fittings and Kitec pipe The Kitec System was used for a variety of applications, including hot and cold water distribution in plumbing applications and radiant heating systems in homesw, residences, buildings and other structures. Kitec Systems are easily identifiable - Kitec pipe is either blue ( for use in cold water) or orange (for use in hot water) and is often stamped "KITEC".
The settlement Agreement defines "Kitec Systems" as all of, wheather as components, individual parts, oe as a system, PEX-AL-PEX, PE-AL-PEX, PERT-ALPERT, PEX pipe, valves, fittings/ or components, manufactured by or on behalf of IPEX Defendants whether sold under the names: KITEC, PLUMbBETTER, IPEX AQUA, WARMRITE, KITEC XPA, AMBIOCOMFORT, APA, KERR CONTROLS, PLUMBERIE AMELLOREE, oe otherwise,
Where the fittings are visible look for the words: KITEC or KTC on them. The terms: CSA B137.9/10 or ATSM F1874 could also indicate you have Kitec System,
To be eligible for settlement benefits you must file a Claim Form prior to the expiration of the claim settlement. The claim filing deadline will be approximately January 1, 2020.
